The New Essential Labour Law Handbook (2019) is the 7th edition of Essential Labour Law, first published in 1998. As before, the approach has been to provide both labour law and labour relations practitioners with a clear and concise introduction to the principles of South African labour law.

A number of important developments in South African labour law after publication of the 6th edition of this handbook in 2017 necessitated a revision to ensure that the book remains as up-to-date and comprehensive as before.

This edition includes an analysis of the National Minimum Wage Act which came into operation on 1 January 2019. It also deals with the new types of leave envisaged in the 2018 amendments to the Basic Conditions of Employment Act, namely parental leave, adoption leave and commissioning parental leave. Also included, are in-depth discussions of the nature of collective bargaining and picketing against the background of the Code of Good Practice: Collective bargaining, industrial action and picketing which was gazetted in December 2018. The handbook furthermore contains a section on strike violence and the Labour Relations Act amendments which came into force on 1 January 2019, aimed at reducing strike violence through mechanisms such as strike ballots and advisory arbitration.

  Moreover, the chapter which deals with dismissal for misconduct now includes an overview of the types of misconduct most commonly encountered in the workplace. The overview is based on a discussion and analysis of the case law relevant to each one of these types of misconduct.

Additionally, where applicable, the handbook highlights and discusses the unique rules relating to public servants.

All of the chapters reflect the important court decisions handed down during the last two years in respect of the Constitutional labor relations rights and all other topics dealt with in this handbook.
